(95) O you who have believed, do not kill game while you are in the state of ihram. And whoever of you kills it intentionally - the penalty is an equivalent from sacrificial animals to what he killed, as judged by two just men among you as an offering [to Allah] delivered to the Ka"bah, or an expiation: the feeding of needy people or the equivalent of that in fasting, that he may taste the consequence of his deed. Allah has pardoned what is past; but whoever returns [to violation], then Allah will take retribution from him. And Allah is Exalted in Might and Owner of Retribution.
I sat next to Ka'b ibn Ujrah in this mosque, and asked him about this verse: {..then compensate either by fasting, charity, or by offering a scrifice..} [Al-Baqarah: 196]. Ka'b said: It was revealed concerning me. I had a scalp ailment, so I was carried to the Messenger of Allah (PBUH), and lice were scattered on my face. He said: I did not think that your were suffering to such an extent as I see. Would you afford to -sacrifice- a sheep? So I said: No, so this verse was revealed: {..then compensate either by fasting, charity, or by offering a scrifice..} [Al-Baqarah: 196]. The Prophet (PBUH) said: Fasting for three days, or feeding six needy people, half a sa' (2 - 4.2 kg) of food for each. Ka'b concluded: It was revealed especially concerning my case, and it is for you in general.
He was with the Messenger of Allah (PBUH) until when they were on the road to Mecca, he left behind with some of his companions who were in ihram, and he was not in ihram. Then he saw a wild ass, so he mounted his horse and asked his companions to give him his whip, but they refused. He asked them for his spear, but they refused, so he took it, then he attacked the ass and killed it. Some of the Prophet’s companions ate from it, but some of them refused to eat. Then when they met the Messenger of Alla (PBUH), They asked him about that, and he said: It is only food that Allah provided you with.
A wild ass was brought to the Prophet (PBUH) at Waddan, so he said,: We are in ihram, we do not eat game.
